Buying Process

Buying property in Turkey is very simple.

As you have found your new home in Turkey, we will ensure your purchase legally verified in all terms. We will make a precise agreement of all terms of the transaction between the vendor and the purchaser. Please rest assured that our company will provide the best service throughout your property purchase proceedings, each step taken carefully according to the law.

At this stage, you will make the first payment according to the payment schedule clearly defined in the agreement.
Upon this payment, the proceedings at the Title-Deeds Office are initiated by us.
We will prepare an application form for the official permit of purchase. With a copy of the property legal papers, together with the copy of your passport, we will send them to the Army Headquarters in Izmir for clearance. This process will take between 6 to 8 weeks and we will watch the procedure on behalf of the client/purchaser. From the 1st January 2006, the property location has to be checked by the municipality. The check is carried out to ensure that the land you are buying does not fall within any military zone or rural area.
You do not have to stay in Turkey during this procedure.

When all the checkings have been conducted and the papers returned to us, we will contact you so that you can arrange a suitable date to return to Turkey to receive a residence permission.
On the day of transfer, the Buyer, Vendor and Estate Agent will go to the Title Deeds Office to complete the paperwork. The paperwork consists of all the legal issues (title deeds, land registry etc) and financial issues. Financial affairs are concluded, signatures exchanged and the title deeds of your property are registered in your name.

As a new owner of the property we will accompany you to the various department offices to get the utilities changed to your name.

• Registry with the municipality for water and electricity and official subscriptions
• Sales transaction tax, 3% on the ‘declared’ value of the property to be once paid to the government.
• Application fee is paid to provide the necessary information and paperwork for the application to the Military such as maps, passport translations, etc
• Translator fee. It is necessary by the lawi in Turkey to have a translator at the stage of Tapu transfer to make sure that the Buyer has accepted the context.
• Iskan fee: Permission for living in exact apartment once paid to the local municipality.
• Garbage tax, paid per year from each apartment to the local municipality.
• Property municipal tax, paid on yearly basis based on approximately 0.1% of the annual evaluation of the property.
• TAPU
A TAPU is an official document which shows you have ownership rights over the real estate. The owner's full name and photograph, and detailed information on the asset appear on this document.
The TAPU has to be sealed with a stamp in the central part at the bottom and this section has to be signed by a TAPU officer.
The picture of all owners are to be suffixed to the top-right of the TAPU, it has to be sealed with a stamp and signed by the TAPU officer.
Whether a property does belong to a person can be checked through the pictures and names appearing on the TAPU. If the TAPU is a Xerox copy, then make sure it has been ratified by a notary public. Otherwise, a fake TAPU might have been handed over to you. With regards to the names, you can ask for the ID card of the seller(s) and compare the TAPU to the ID card in terms of names.

Foreign Ownership

Foreigners are allowed to own freehold property in Turkey away from military zones if the country they herald from has a reciprocal agreement; i.e., if your country of residence allows Turkish residents to own property in your country then you can buy in Turkey!
Countries Turkey have a reciprocal agreement for the purchase of land and properties with a majority of the ONU countries.
